Republic Act 10022, an amendment to RA 8042 (the Migrant Workers and Overseas Filipinos Act of 1995), mandates that Overseas Filipino Workers (OFWs) have insurance coverage to protect them from the various risks associated with working abroad. This insurance provides benefits such as compensation for death due to natural causes or accidents, repatriation in case of death or other circumstances requiring the OFW’s return home, medical evacuation, compassionate visits during extended hospitalization, and assistance in cases of unjust employment termination or legal proceedings. 


 The OFW Insurance policy is best aligned with the duration of the OFW’s employment contract to ensure continuous protection throughout the entire employment period. 


NATURAL DEATH BENEFIT:  Benepisyong nagkakahalaga ng $10,000 na ibibigay sa mga itinalagang benepisyaryo ng OFW sa kaso ng pagpanaw dahil sa sakit o anumang natural na sanhi.


ACCIDENTAL DEATH BENEFIT: Benepisyong nagkakahalaga ng $20,000 na ibibigay sa itinalagang benepisyaryo ng OFW sa kaso ng pagpanaw dulot ng aksidente.  


PERMANENT TOTAL DISABLEMENT BENEFIT:  Benepisyong nagkakahalaga ng hanggang $7,500 na ibinibigay sa OFW sakaling mabaldado at hindi na makapagtrabaho muli. Ang halaga ng benepisyo ay batay sa schedule of benefits na nakasaad sa policy contract. 


REPATRIATION BENEFIT:  Benepisyong sasagot sa gastusin sa pag-uwi ng OFW sa Pilipinas, buhay man o pumanaw, kasama ang mga personal na gamit. 


SUBSISTENCE ALLOWANCE BENEFIT:  Benepisyong nagkakahalaga ng US$100 bawat buwan sa loob ng hanggang anim (6) na buwan sakaling ang OFW ay masangkot sa isang kaso o paglilitis sa bansang pinagtatrabahuhan. 


MONEY CLAIMS BENEFIT:  Benepisyong katumbas ng tatlong (3) buwang sahod para sa bawat taon ng kontratang nawala dulot ng ilegal na terminasyon, batay sa desisyon ng NLRC. Ang halagang matatanggap ay hindi hihigit sa US$1,000 bawat buwan at hindi lalampas sa anim (6) na buwan. 


COMPASSIONATE VISIT:  Benepisyong nagbibigay sa OFW ng pagkakataong humiling na madalaw ng isang taong nais niya kung siya ay naospital nang hindi bababa sa pitong (7) magkakasunod na araw. 


MEDICAL EVACUATION:  Benepisyong sasagot sa paglilipat ng OFW sa isang pasilidad na may kakayahang magbigay ng angkop na medikal na atensyon 


MEDICAL REPATRIATION:  Benepisyong magpapauwi sa OFW kapag ito ay binigyan ng kaukulang pahintulot ng doktor dahil sa kanyang medikal na kondisyon.

In the event of a claim arising from accidental or permanent total disablement, the following documents, duly authenticated by the Philippine foreign posts or by the local registry if death occurs in the Philippines, whichever is applicable, will serve as sufficient evidence to substantiate the claim:

  1. Death Certificate – required in the event of accidental death;
  2. Police or Accident Report – required in the event of an accident;
  3. Medical Certificate – required in the case of permanent disablement.


Additionally, for the purpose of identifying the legitimate and/or designated beneficiaries, the following claim documents must also be submitted:

  1. Birth Certificate of the insured, if the beneficiary is a parent or a child;
  2. Marriage Contract of the insured and spouse, if the beneficiary is the spouse;
  3. Affidavit of Legal Guardianship, if the beneficiary is a minor;
  4. Other supporting documents as may be necessary to establish the identity of the claimants.


For Repatriation, the following documents must be provided:

  1. Certification stating the reason(s) for the termination of the migrant worker’s employment and the need for repatriation, issued by the Philippine foreign post or POLO located in the receiving country;
  2. Photocopy of Passport;
  3. Copy of Return Trip Ticket;
  4. Official Receipt.


For Subsistence Allowance Benefit Claims, the following must be submitted:

  1. Certification issued by the concerned Labor Attaché or, in their absence, by the embassy or consular official, which should include the title of the case, the names of the parties involved, and the nature of the cause of action of the migrant worker.


For the Settlement of Money Claims, a certified true copy of the final decision of the NLRC or the compromise agreement should be provided.


For Compassionate Visits, the following documents must be submitted:

  1. Medical Report;
  2. Certification confirming that the OFW has been confined for at least seven (7) days;
  3. Official receipt for the payment of the airline ticket.


For Medical Evacuation/Repatriation, the necessary documents are:

  1. Medical Certificate;
  2. Document detailing the breakdown and total cost of the evacuation/repatriation.


ACCIDENT/NATURAL DEATH:

  1. Authenticated Death Certificate issued by Philippines foreign post
  2. Death Certificate from the local Civil Registrar
  3. Incident Report from employer
  4. Police Report in case of accident
  5. Employment Contract and OEC (Overseas Employment Certificate)
  6. Original POC and Receipt


 PERMANENT AND TOTAL DISABLEMENT/DISMEMBERMENT

  1. Medical Certificate
  2. Accident Report from employer or police
  3. Picture of the disabled person or affected parts of the body
  4. Employment Contract and OEC (Overseas Employment Certificate)
  5. Original POC and Receipt
  6. PTD Form


ADDITIONAL DOCS FOR THE LEGAL BENEFICIARY:

  1. Birth Certificate of insured, if beneficiary is a parent or a child
  2. Marriage Contract of insured and spouse, if beneficiary is the spouse
  3. Affidavit of Legal Guardianship, if beneficiary is a minor


REPATRIATION:

  1. POLO (Philippine Overseas Labor Office) Certificate which states the reason/s for termination of the OFW’s employment and the need for his/her repatriation by the Philippines foreign post
  2. Travel Itinerary with Invoice
  3. Official Receipt/ Proof of payment
  4. Employment Contract & OEC (Overseas Employment Certificate)
  5. Passport/Visa with arrival & departure stamp
  6. OFW Affidavit
  7. Original POC & Receipt
  8. Seaman's Book for Seafarer
  9. Master’s Report


MEDICAL REPATRIATION:

  1. Medical Certificate documenting the breakdown and total cost of repatriation
  2. Accident Report
  3. Travel Itinerary with Official Receipt
  4. Employment Contract and OEC (Overseas Employment Certificate)
  5. Passport/Visa with arrival & departure


SUBSISTENCE ALLOWANCE:

  1. Polo Certificate stating the title of the case, the names of the parties and the nature of the cause of action of the OFW.
  2. Employment Contract and OEC (Overseas Employment Certificate)
